O estatuto jurídico dos animais não-humanos, em especial no âmbito do direito civil

Abstract

A presente dissertação tem por objeto o estudo do estatuto dos animais não-humanos, no ordenamento jurídico português, dando especial atenção às alterações introduzidas pela Lei n.º 8/2017 no Código Civil vigente. Para esse fim, parte de uma análise da evolução do seu estatuto na filosofia e na ciência, e depois a nível de Direito Comparado. O estudo não é circunscrito apenas ao Direito Civil, ainda que incida principalmente sobre este, mas também a outros ramos de direito, nomeadamente o Direito Constitucional e o Direito Penal.

The purpose of this dissertation is to study the status of non-human animals in the Portuguese legal system, paying special attention to the changes introduced by Law no. 8/2017 in the current Civil Code. To this end, part of an analysis of the evolution of its status in philosophy and science, and then at the level of Comparative Law. The study is not only limited to Civil Law, although it focuses mainly on this, but also on other branches of law, namely Constitutional Law and Criminal Law.
