Colaboração premiada : o questionamento sobre a moralidade e a efetividade do instituto

Abstract

O presente trabalho tem por escopo realizar uma análise do instituto da colaboração premiada a partir de sua fundamentação político-criminal, de modo a atingir a tensão que mantém em relação a determinadas garantias fundamentais do acusado, principalmente quando nos referimos ao agente colaborador. O objetivo central é constatar a eficiência desse mecanismo persecutório diante do sistema penal hodierno, verificando ainda a finalidade do instituto, e se o mesmo cumpre o desiderato de combater a criminalidade altamente complexa. Para tanto, a pesquisa foi realizada com base em diversos e renomados autores da área penal e processo penal, além do exame legislativo e jurisprudencial, contrastando com algumas linhas de atuação e de pensamentos presentes em alguns ordenamentos jurídicos. O intuito de presente estudo era o de que se chegasse a uma análise de como é o processo da colaboração premiada e entender a maneira que essa cooperação interfere nos trâmites judiciários, e também aprofundar na origem e objetivos da delação.

This paper intends to analyze the use of the awarding accusation after the use of its political-criminal principles, in order to reach the tension kept in relation with some fundamental guarantees of the accused one, especially when referring to the collaborator agent. The main objective of this work is to verify the efficiency of this persecutory mechanism in face of the contemporary penal system, finding out the goal of its application, as well as whether it meets the aspiration of fighting highly complex criminality. To reach this purpose, the subject was deeply researched using literature of several renowned authors of the criminal proceeding area, in light of legislative and jurisprudential exams, in contrast with some running investigative procedures and thoughts found in recent legal orders. The target of this study is to develop an understanding of the award accusation legal process, in order to connect it to the judicial proceedings and its interference in the whole process, as well as deepen the exam of origin and objectives of the award accusation.
